Non-Immigrant Visas (Temporary)
Nonimmigrant visas are issued to foreign nationals who intend to remain in the United States for a temporary (less than permanent) period of time. The period of stay varies for different nonimmigrant categories. There are more than 40 nonimmigrant U.S. visa categories; each is used for a different, but very specific purpose. For example, some authorize temporary employment in the United States; others permit tourists to visit, students to study, and diplomats to serve their home country's interests in the United States.
At Sever-Storey, LLP, we help our clients understand and apply for temporary nonimmigrant visas. Also, we understand that plans can change. As a result, you may be required to change your nonimmigrant status before you may lawfully begin to engage in the activities you want to pursue. Application procedures vary depending on the nonimmigrant status to which you want to change. We specialize in helping nonimmigrants apply for a change from their current nonimmigrant status to another nonimmigrant status while they are in the United States.
We also understand that you may wish to remain in the United States longer than you originally planned to under your original nonimmigrant visa classification. When you were admitted to the United States, a Government official at a U.S. port of entry examined you immigration documentation and issued you a Form I-94. This document shows the length of time you can remain lawfully in the United States. The attorneys at Sever-Storey, LLP help nonimmigrants apply for an extension of stay in the United States to continue the same activities permitted when they were first admitted to this country.
TEMPORARY (NON-IMMIGRANT) WORKERS
Many of our clients are temporary workers in the United States. In order for them to have come into the United States lawfully as nonimmigrants their prospective employers must have submitted a petition on their behalf to the U.S. Citizenship and Immigration Services.
If you are presently outside the United States, on the other hand, you must petition for a visa and wait for approval. You may then use the visa to seek admission to the United Stats as a nonimmigrant. If you are already in the United States, you may be eligible to apply for a change to the correct nonimmigrant classification, or for an extension of stay.
At Sever-Storey, LLP, we handle all types of temporary worker visa applications. The following is a brief list of visas we would be happy to assist you with:
- H1-B: workers in a specialty occupation.
- H-2A: temporary or seasonal agricultural worker.
- H-2B: temporary or seasonal nonagricultural worker.
- R-1 and R-2: religious workers and spouses and children of religious workers.
- TN: North American Free Trade Agreement (NAFTA) temporary professionals from Mexico and Canada.

If you would like to study as a full-time student in the United States, you will need a student visa, and the attorneys at Sever-Storey, LLP are here for your assistance. You may be eligible for one of the two main nonimmigrant student visas; an 'F' visa is available for academic students, and an 'M' visa is for vocational students. A third category, the 'J' visa, is also available for educational and cultural exchange programs that have been designated by the Department of State, Bureau of Consular Affairs.
Many student visa holders wonder if they are able to accept employment during their education. Student visa holders are subject to certain restrictions and conditions when seeking employment opportunities and should consult with our attorneys for further assistance.
